A BFA or BVwG decision can matter even when the person concerned is already abroad. The decisive question is how the document was served and when the deadline started.

This article treats service abroad, power of attorney and deadline start as a separate situation. General precautions on an address for service remain a different topic.

01 Question 1

Where is the service problem?

With an international element, the first step is reconstructing service.

All paths at a glance

Overview of all answers.

01

Clarify service first.

A decision received abroad is not a reason to wait. Service, representation and deadline must first be put into a reliable timeline.

02

Check representation separately.

A decision received abroad is not a reason to wait. Service, representation and deadline must first be put into a reliable timeline.

03

Check missed deadline immediately.

A decision received abroad is not a reason to wait. Service, representation and deadline must first be put into a reliable timeline.

Reconstruct service and receipt

Envelope, proof of service, date of receipt, collection notice and email forwarding may all matter for the deadline. None of this should be discarded.

If the appeal information seems unclear, the article on wrong appeal instructions should also be checked.

Clarify power of attorney and service authority

Where representation exists, it must be checked who was effectively authorised and where service was allowed. A power of attorney only helps if it can be proven in the file.

The organisational side is explained in the article on power of attorney in immigration proceedings.

Do not estimate the start of the deadline

With service abroad, the deadline start can be harder to reconstruct. It should still not be guessed. Decision, service trail and previous communication belong together.

If a deadline was already missed, reinstatement after a missed deadline is a separate checkpoint.

Practical point: A decision received abroad is not a reason to wait. Service, representation and deadline must first be put into a reliable timeline.
